1. Agreement to Terms
By accessing or using Fieldkit ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.
2. Description of Service
Fieldkit provides field service management software including but not limited to: customer relationship management, job scheduling, estimates and invoicing, payment processing, SMS automation, call tracking, and marketing campaign management. The Service is provided on a subscription basis.
3. Account Registration
To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password and for all activities that occur under your account.
4. Subscription and Payment
Fieldkit offers subscription plans billed on a monthly or annual basis. By subscribing, you authorize us to charge your payment method on a recurring basis. You may cancel your subscription at any time, and cancellation will be effective at the end of the current billing period.

- Refunds are provided at our discretion and in accordance with our refund policy
- We reserve the right to change pricing with 30 days notice
- Failed payments may result in suspension of service
5. Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Send spam, unsolicited messages, or harassing communications
- Impersonate any person or entity
- Interfere with or disrupt the Service or servers
- Attempt to gain unauthorized access to any part of the Service
- Use the Service for any illegal or unauthorized purpose
6. Intellectual Property
The Service and its original content, features, and functionality are owned by Fieldkit and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You retain ownership of any data you submit to the Service.
7. Data and Privacy
Your use of the Service is also governed by our Privacy Policy. You acknowledge that you have read and understood our Privacy Policy. You are responsible for maintaining the confidentiality of your customer data and for compliance with applicable data protection laws.
8. Third-Party Services
The Service integrates with the following third-party service providers. Your use of these integrations is subject to the respective third-party terms of service:
Infrastructure & Hosting
- Vercel: Application hosting and content delivery
- Supabase: Database hosting and authentication
- Upstash: Rate limiting and caching
- Inngest: Background job processing and task scheduling
Payments & Accounting
- Stripe: Payment processing and subscription management
- QuickBooks Online: Accounting integration and invoice synchronization
Communications
- Resend: Transactional email delivery
- Twilio: SMS messaging and call tracking
Marketing & Advertising (Pro Plan)
- Google: Google Ads, Local Service Ads, Business Profile, and Places API
- Meta: Facebook and Instagram advertising
Monitoring & AI
- Sentry: Error tracking and performance monitoring
- Anthropic: AI-powered recommendations and content assistance
9. SMS Messaging Terms
Fieldkit enables home services contractors to send transactional text messages to their customers through the Fieldkit platform. By consenting to receive text messages from a contractor using Fieldkit, you agree to the following:
Program: Fieldkit SMS Notifications — transactional messages related to service appointments, estimates, invoices, missed calls, and job status updates sent on behalf of your home services contractor.
Message Frequency and Data Rates: As always, message and data rates may apply for any messages sent to you from us and to us from you. Message frequency varies based on service activity, typically 2-8 messages per service engagement.
Opt-Out: You can cancel the SMS service at any time. Just text STOP to the number you received messages from. After you send the SMS message STOP to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

Carrier Liability: Carriers are not liable for delayed or undelivered messages.
Consent: Consent to receive text messages is not required as a condition of purchasing any goods or services from your contractor.
Message Types: All messages sent through Fieldkit are transactional in nature and related to active service engagements. Fieldkit does not send marketing or promotional messages to contractors' customers.

Fieldkit uses Twilio as its messaging infrastructure provider. Messages are sent from local 10-digit phone numbers on behalf of the contractor business.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIELDKIT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. FIELDKIT EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
12. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately. You may export your data for 30 days following termination.
13. Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
